Summary

The GDPA  requires a governmental entity that collects personal data to provide a procedure by which an individual may request an amendment or correction of:

  • personal data that has been furnished to the governmental entity; and
  • information concerning an identifiable individual contained in a record maintained by the governmental entity.

However, a governmental entity is not required to make the requested amendment or correction.

GRAMA also allows an individual to contest the accuracy or completeness of any public, private, or protected record concerning the individual. If the governmental entity approves the request, the record must be corrected and may not be disclosed until it has been amended.

If the governmental entity denies the request, the requester may submit a written statement that must be filed with the disputed record. The governmental entity must disclose this statement along with the record whenever it is disclosed.
