Template 1 – Contracts that Involve Personal Data

Utah Code § 63G-2-206(6) provides requirements and restrictions under which an entity may disclose records that contain personal data with contractors and private providers. Utah Code § 63A-19-401(4) includes new requirements for contractors who enter into or renew a contract to process personal data on behalf of a governmental entity. After May 1, 2024 these contracts must include language which requires a contractor to comply with the requirements of the GDPA to the same extent as a governmental entity. This template includes specific privacy terms and conditions that governmental entities may include in their contracts. 


Template 2 – Agreements for Data Sharing

Whenever a governmental entity shares data with another governmental entity the parties should enter into a written agreement or data sharing agreement that describes how the data must be protected and how the data can be used. This Data Sharing Agreement (DSA) template is provided to assist governmental entities when creating a DSA. Legal counsel should be consulted regarding these data sharing provisions.
